The Director of Public Prosecutions has withdrawn the fraud case against former Football Kenya Federation boss Nick Mwendwa that started eight months ago.
Together with the National Executive Council, Mr Mwendwa was kicked out of office in November last year by Sports CS Amina Mohammed who then appointed a caretaker committee to manage FKF.
He was first arrested on November 14 before he was released and re-arrested over fraud charges.
Mr Mwendwa jointly with others allegedly conspired to defraud FKF a whooping Sh29 million and is also accused of having fraudulently acquired Sh2.5 million public property in May last year.
The charge sheet indicated that the suspect, who was out on Sh10 million bond, is also said to have fraudulently acquired Sh6 million properties between March 4 and May 6 this year.
The DPP, under the Section 87 of the Penal Code Tuesday (July 6) applied for adjournment of the case as they had no witness and wanted to review the evidence.
The application was however denied by Milimani Anti-Corruption Chief Magistrate Eunice Nyuttu who directed that the case proceeds tomorrow.
The court discharged Mr Mwendwa over “failure by DPP to avail evidence” before court.
The Magistrate said the DPP had “abused court process” for arresting and producing the suspect in court without evidence.
