More than 20 Chief Administrative Secretaries appointed by President Uhuru Kenyatta in 2018 have been serving illegally.
High Court Judge Antony Mrima on April 20 stated that the law was not followed when the positions were created terming them unconstitutional.
Also in office illegally are Cabinet Secretaries who continued to serve in the Uhuru-Ruto government without undergoing vetting after re-election in 2017 according to Justice Mrima’s ruling.
Activist Okiya Omtata after the appointments moved to court challenging the creation of the new office of CAS on grounds that there was no public participation before the positions were introduced.
President Uhuru Kenyatta on January 26, 2018 announced the creation of CAS position saying they would be responsible for helping the CSs improved coordination in respective ministries.
