Tuko editor Didacus Malowa has obtained a relieve after the High Court set aside a lower court’s decision to jail him over alleged disregard of a court order to publish an apology for reportedly misreporting on the Sh226 million National Youth Service graft scandal.
Justice Esther Maina ordered his immediate release following an application by the editor seeking stay on Chief Magistrate Eunice Nyutu’s decision.
The magistrate court had sentenced the editor for contempt without fine for failing to comply with its orders to apologise and retract the story.
His lawyers had applied to have the sentence suspended on grounds that there was a matter before the High Court seeking review of initial orders that fined the editor Sh50, 000.
